Terms of Service – Big Social Recruiting

Welcome to Big Social Recruiting, a division of Big Ideas Social Media Recruitment Pvt. Ltd. By accessing or utilizing our professional services, you agree to be bound by the following terms and conditions. These terms govern the relationship between Big Social Recruiting (“the Company”) and the client (“the Client”).
1. Scope of Services
Big Social Recruiting provides comprehensive human resource and branding solutions, including but not limited to:
- Talent sourcing (specializing in passive candidates)
- Full-cycle recruitment and staffing services
- Social media-driven hiring campaigns
- Employer branding and hiring strategy consulting
- Recruitment Process Outsourcing (RPO)
2. Engagement and Acceptance
Engagement is established when the Client provides confirmation via email, messaging platforms, or formal agreement to proceed with our services. Any shared job requirement or mandate provided by the Client will be treated as an official engagement and acceptance of these terms.
3. Candidate Submission and Ownership
- Sourced Candidates: All candidates introduced or shared by Big Social Recruiting are considered our sourced candidates.
- Ownership Period: Candidate ownership remains valid for a period of 12 months from the date of submission.
- Validity: If a candidate is hired directly or indirectly by the Client within this 12-month period, the Client is liable for the applicable placement fees.
4. Engagement Models and Fee Structure
We offer flexible pricing models tailored to meet diverse organizational needs:

5. Payment and Replacement Terms
5.1 Replacement Guarantee
We provide up to a 12-week replacement assurance. This guarantee is applicable if the candidate exits within the period and the original invoice has been settled in full.
5.2 Payment Schedule
- Invoicing: Raised on the candidate’s official joining date.
- Due Date: Payment is due within 15–30 days of the invoice date.
- Late Fees: Delayed payments may attract applicable interest charges.
5.3 Refund Policy
All fees paid are non-refundable. In the event of a candidate exit within the guarantee period, a replacement will be provided as the primary remedy.
6. Client Responsibilities
To ensure the success of the hiring process, the Client agrees to:
- Provide accurate and detailed job descriptions.
- Share timely feedback on submitted candidate profiles.
- Maintain professionalism during the interview and selection process.
- Inform Big Social Recruiting of hiring decisions promptly.
7. Non-Circumvention and Confidentiality
- Non-Circumvention: Clients shall not bypass Big Social Recruiting to hire shared candidates directly or through third parties. Any such hire will incur full placement fees.
- Confidentiality: All candidate data and hiring discussions are strictly confidential. Neither party shall share sensitive information or candidate profiles externally without prior written consent.
8. Legal and Compliance
- Data Privacy: Both parties agree to comply with applicable data protection laws. Candidate data is shared strictly for professional hiring purposes.
- Limitation of Liability: The Company is not liable for candidate performance post-hire, business losses, or indirect damages. Total liability is limited to the fees paid for the specific hire.
- Governing Law: These terms are governed by the laws of India, with exclusive jurisdiction in the courts of Ahmedabad, Gujarat.
